Terms of Service

These Terms of Service ("Terms") are a legal agreement between you ("you" or "User") and Moonlighter Jobs, LLC ("we," "us," or "Moonlighter"). By accessing or using the platform located at moonlighterjobs.com (the "Platform"), you agree to be bound by these Terms. If you do not agree, you may not use the Platform.

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on the Platform with an updated "Last Updated" date. Your continued use of the Platform after any such changes constitutes acceptance of the new Terms.

Moonlighter is an invite-only salary transparency platform designed for emergency medicine ("EM") physicians. The Platform allows verified physicians to anonymously submit compensation data — including hourly rates, employment type (W-2 or 1099), and work location — and view an interactive geographic heatmap of aggregated, anonymized salary data.

All salary data displayed on the Platform is processed through spatial interpolation and anonymization techniques. Individual submissions are never displayed directly. The Platform enforces minimum data density thresholds before rendering any geographic area, ensuring that individual data points cannot be reverse-engineered or identified.

The Platform is available exclusively to licensed or in-training emergency medicine physicians in the United States. You must be at least 18 years of age to use the Platform.

Access is invite-only. You may register only if you have received a valid, unexpired invite link from an existing member. Each invite link is single-use and expires after a set period. We reserve the right to revoke invitations and terminate accounts at our discretion.

The Platform supports two account types: "Attending" (practicing EM physicians who must submit salary data to access the map) and "Resident" (physicians in training who may access the map without submitting salary data).

When registering, you agree to provide accurate information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at info@moonlighterjobs.com if you believe your account has been compromised.

Each account is personal and non-transferable. You may not share your account credentials or invite links with non-physicians or individuals outside the emergency medicine community.

By submitting salary data to the Platform, you represent and warrant that: (a) the information you provide is truthful and accurate to the best of your knowledge; (b) the data reflects your own compensation and not that of a third party; and (c) submitting this data does not violate any contractual obligation, including but not limited to non-disclosure agreements with your employer.

You understand and agree that your submitted salary data will be: (a) normalized to a 1099-equivalent hourly rate using a standardized correction formula that accounts for employer-side tax contributions; (b) geocoded based on the zip code you provide; (c) aggregated with other submissions and processed through Inverse Distance Weighting (IDW) spatial interpolation; and (d) displayed only in anonymized, interpolated form on the Platform's heatmap.

We take anonymization seriously. Individual salary submissions are never displayed directly to other users. However, no anonymization technique is perfect, and we cannot guarantee that your data will be impossible to infer in all circumstances — particularly in geographic areas with very few submissions. The Platform enforces a minimum density threshold before rendering any area on the map, but you acknowledge that residual re-identification risk exists.

Attending physicians must maintain at least one active salary entry to retain access to the map. You may update or add additional entries at any time.

You agree not to: (a) submit false, misleading, or fabricated salary data; (b) create multiple accounts or use another person's account; (c) share invite links with individuals who are not emergency medicine physicians; (d) attempt to reverse-engineer, de-anonymize, or identify individual salary submissions from the map data; (e) scrape, crawl, or use automated means to access or extract data from the Platform; (f) use the Platform's data for commercial purposes, including but not limited to staffing, recruiting, or contract negotiation on behalf of an employer or staffing agency; (g) interfere with or disrupt the Platform's infrastructure or security; or (h) use the Platform in any manner that violates applicable law.

You understand that the vouch-based invite system is a trust mechanism. Inviting a user who violates these Terms may result in consequences for your account as well, including reduction of invite privileges or account suspension.

By submitting data to the Platform, you grant Moonlighter Jobs, LLC a non-exclusive, royalty-free, worldwide license to use, process, aggregate, anonymize, and display your submitted salary data as part of the Platform's services.

We may compile, aggregate, and analyze submitted data to produce anonymized, statistical insights about EM physician compensation. Such aggregated data, from which no individual can be identified, is the property of Moonlighter Jobs, LLC.

The Platform — including its design, code, interpolation algorithms, visual presentation, and all associated materials — is the property of Moonlighter Jobs, LLC and is protected by applicable intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended purpose.

You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any part of the Platform without our prior written consent. You may not use the Moonlighter name, logo, or branding without authorization.

THE PLATFORM AND ALL DATA, MATERIALS, AND SERVICES PROVIDED THROUGH IT ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

THE SALARY DATA DISPLAYED ON THE PLATFORM IS USER-SUBMITTED, SELF-REPORTED, AND PROCESSED THROUGH STATISTICAL INTERPOLATION. WE DO NOT VERIFY THE ACCURACY OF INDIVIDUAL SUBMISSIONS. THE DISPLAYED DATA SHOULD BE USED FOR INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE FINANCIAL, LEGAL, TAX, OR EMPLOYMENT ADVICE. YOU SHOULD NOT RELY SOLELY ON PLATFORM DATA WHEN MAKING COMPENSATION OR EMPLOYMENT DECISIONS.

WE MAKE NO WARRANTY THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOONLIGHTER JOBS, LLC, ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE PLATFORM EXCEED ONE HUNDRED DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

You agree to indemnify, defend, and hold harmless Moonlighter Jobs, LLC, its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or contractual right; or (d) any salary data or other content you submit to the Platform.

We may suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to: submission of false data, abuse of the invite system, attempts to de-anonymize data, or any other violation of these Terms.

Upon termination, your right to use the Platform ceases immediately. We may, but are not obligated to, delete your account data, including salary submissions. Provisions of these Terms that by their nature should survive termination — including Sections 6 through 12 — will survive.

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles. Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Dutchess County, New York, and you consent to the personal jurisdiction of such courts.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Moonlighter Jobs, LLC regarding your use of the Platform.

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
